The duration of the notice period is primarily governed by the individual employment agreement, subject to State Shops and Establishments Act mandates (which typically prescribe 30 days for permanent employees).
Notice Buyout Recovery = (Monthly Salary Base ÷ 30) × (Mandatory Days − Served Days − Leave Offsets)
1. Leave Adjustment Offsetting
While an employer cannot be compelled to approve leave adjustments during the notice period, mutually agreed encashable leaves can legally offset shortfall notice days to reduce financial recovery deductions in the Full and Final (FnF) statement.
2. Withholding Relieving Letters
If an employee pays the contractual shortfall notice amount in lieu of notice, the employer is legally obligated to release the relieving and experience certificates without delay.
