Is gratuity payable if I resign after 4 years and 8 months?
Under Section 4(2) of the Payment of Gratuity Act 1972 and landmark Madras High Court rulings, completion of 4 years and 240 days of continuous service (in a 6-day workweek) or 190 days (in a 5-day workweek) during the 5th year qualifies as a completed continuous year, making the employee eligible for statutory gratuity.
Can an employer hold back my relieving letter for unserved notice?
An employer cannot arbitrarily withhold service/relieving certificates. If the employment contract provides for a notice period buyout, the employee is entitled to adjust shortfall notice against leave balance or pay salary in lieu of notice. Withholding experience certificates for arbitrary disputes is impermissible under Indian service jurisprudence.
What is the maximum salary ceiling for mandatory EPF and ESI?
For EPF, the statutory wage ceiling is ₹15,000 per month (Basic + DA). For ESI, the gross monthly wage ceiling is ₹21,000 per month (₹25,000 per month for employees with disabilities). Employees earning above these limits are not mandatorily covered unless opted voluntarily.
