Is 5 years of continuous service strictly mandatory for gratuity?
Yes, Section 4(1) of the Payment of Gratuity Act 1972 mandates 5 years of continuous service. However, under judicial precedents (Section 2A), completing 4 years and 240 days in a non-seasonal establishment satisfies the 5-year requirement. In case of death or disablement, the 5-year condition is waived entirely.
Can an employer recover notice pay if an employee resigns with short notice?
Yes, if stipulated in the appointment letter, the company can recover salary for the shortfall period (calculated on Basic + DA or Gross as per contract). However, an employer cannot arbitrarily reject a resignation or withhold earned PF / Gratuity dues.
What is the statutory wage ceiling for EPF and ESI coverage?
EPF statutory wage ceiling is ₹15,000 per month (Basic + DA), though employers and employees can voluntarily contribute on actual higher wages. ESI coverage is mandatory for employees with a gross monthly wage up to ₹21,000 (₹25,000 for employees with disabilities).
